> The regulation of broadcasting issues under the new regulatory framework

This study was funded by the European Commission to investigate how EU Member States have implemented the broadcasting related provisions of the electronic communications regulatory framework, including those on:

  • authorisation of electronic communications networks and services for distribution of radio and television programmes;

  • rights of use for radio frequencies for broadcasting;

  • must-carry obligations; and

  • access to networks and associated facilities (conditional access systems (CAS), application program interfaces (APIs) and electronic program guides (EPGs)).

    The study explains how the broadcasting provisions of the regulatory framework have been implemented in the 25 Member States and identify areas where differences and inconsistencies in implementation, or over-regulation, could potentially create difficulties for the internal market. It also presents recommendations as to where improvements can be made in view of the evolution of the broadcasting landscape.

    The study was completed in December 2006 and accepted by the European Commission. The European Commission has copyright on it and has instructed Cullen International to keep it confidential.
